ITC initial determination finds Microsoft doesn't infringe Motorola peertopeer wireless patent


Microsoft and Motorola's spat in the International Trade Commission started way back in 2010, but it looks like the case may be finally drawing to a conclusion after an initial ruling in Moto's favor was remanded for a second look. Reuters reports that on remand, the presiding administrative law judge reversed his stance in a new initial determination, clearing Microsoft of the remaining infringement charge for patent number 6,069,896 on wireless peer-to-peer technology. In response to this bit of good news, Microsoft VP Corporate VP and deputy general counsel had this to say:



We are pleased with the Administrative Law Judge's finding that Microsoft did not violate Motorola's patent and are confident that this determination will be affirmed by the Commission.


Back in October of last year, Motorola dropped the two WiFi-related patents it had asserted against Microsoft, and in January of 2013 it dropped both of its H.264 related patents from the ITC proceeding. With this latest ruling, it looks like Microsoft will escape from the ITC scott free, though it's not out of the woods yet, as the final call from the full commission won't occur until July. And, of course, Motorola can always take things to the Court of Appeals for the Federal Circuit should it choose to do so. Isn't the system of endless appeals that is the United States judicial system wonderful?

Nike confirms no FuelBand app for Android in development, doesn't rule out future support

Nike's always been tight with Apple, as its Nike+ platform has gotten along with iPods and iPhones for years, and the cooperation continued with an iOS app for the FuelBand. Given the number of Android users out there, many figured the Swoosh would also release a 'droid friendly version, but it turns out those expectations will remain unfulfilled... for now. Nike Support's Twitter account confirmed as much today, saying its devs are focused on iOS and web and are not working on an Android app. Why no love for the little green 'bots? Well, Nike had this to say:



To deliver the best experience for all Nike+ FuelBand users, we are focusing on the FuelBand experience across iOS and nikeplus.com, where you can sync your activity, set new goals, and connect with friends. At this time, we are not working on an Android version of the mobile app.


When we asked if it's shelving its Android efforts permanently, the company informed us that it was not -- meaning we may see such an app at some undisclosed time in the future. So, hope springs eternal for all you FuelBand users with Googlefied phones.

With BlackBerry 10 devices wending their way into the hands of patient fans, there's been some uncertainty as to just what service plans customers need to reach the new platform's full potential. The short answer, after confirmations at CrackBerry: just about any of them. Unlike older BlackBerrys, the Z10 and future models don't require tiers with BlackBerry Internet Service or BlackBerry Enterprise Server support in order to work their push messaging magic. Those migrating from a regular BlackBerry plan won't have to worry about switching, though. The lone exceptions are subscribers who have barebones, social-only plans where BIS serves as the filter. While the switch could lead to price hikes for those cost-conscious users, it's otherwise good news for BlackBerry devotees who've wanted the same choice in service as the rest of their smartphone-owning peers.
